1. Agreement to Terms

By accessing and using the services of MK Home Decor ("we," "our," or "us"), you ("client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services

MK Home Decor provides interior design services including but not limited to:

• Residential and commercial interior design
• Space planning and optimization
• Custom furniture design
• Renovation and remodeling consultation
• Design consultation and project management

All services are subject to availability and our professional discretion.

3. Project Agreements

Each project will be governed by a separate written agreement that will include:

• Scope of work and deliverables
• Project timeline and milestones
• Fee structure and payment terms
• Specific terms and conditions for the project

In case of conflict between these general terms and a specific project agreement, the project agreement shall prevail.

4. Payment Terms

Unless otherwise specified in a project agreement:

• A retainer fee is required before work begins
• Payments are due within 30 days of invoice date
• Late payments may incur interest charges
• All prices are subject to applicable taxes
• Additional costs for changes in scope will be billed separately

5. Client Responsibilities

Clients are responsible for:

• Providing accurate information about the project
• Timely approval of designs and selections
• Ensuring access to the project site
• Obtaining necessary permits and approvals
• Coordinating with contractors and vendors
• Making timely payments as agreed

6. Intellectual Property

All design concepts, drawings, specifications, and other creative work remain the intellectual property of MK Home Decor until full payment is received. Upon full payment, clients receive a license to use the designs for the specific project only.

7. Warranties and Disclaimers

We warrant that our services will be performed with professional skill and care. However:

• We do not warrant the performance of third-party contractors or vendors
• We are not responsible for structural or mechanical issues
• Color variations in materials and finishes are normal
• We disclaim all other warranties, express or implied

8. Limitation of Liability

Our liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project. We shall not be liable for indirect, consequential, or punitive damages.

9. Cancellation and Termination

Either party may terminate a project agreement with written notice. In case of termination:

• Client shall pay for all work completed to date
• Unused retainer amounts will be refunded
• All work product remains our property until payment
• Confidentiality obligations continue after termination

10. Force Majeure

We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, or material shortages.

11. Confidentiality

We respect client privacy and will maintain confidentiality of all client information. We may use project images for marketing purposes unless specifically prohibited by the client in writing.

12. Dispute Resolution

Any disputes arising from our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney fees.

13. Governing Law

These terms shall be governed by the laws of the state where our principal office is located, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the effective date. Continued use of our services constitutes acceptance of modified terms.
